TERMS OF SERVICE
OVERVIEW
Welcome to SinaVita. “We”, “us” and “our” refer to MIM Pharma AS (org. no. 911 618 397), which operates the SinaVita online store at sinavita.com. This includes all information, content, features, products and services we offer there (the “Services”). The store runs on Shopify.
These terms, together with the policies they refer to (the “Terms”), describe your rights and responsibilities when you use the Services. By visiting the store or placing an order, you accept the Terms and our Privacy Policy. Nothing in these Terms limits your mandatory rights as a consumer under Norwegian law, including the Consumer Purchases Act (forbrukerkjøpsloven) and the Cancellation Act (angrerettloven).
SECTION 1 – AGE AND ACCOUNT
You must be at least 18 years old to place an order. If a product is used by a child, it must be used under adult supervision and according to the instructions for use.
You confirm that the information you give us (email, billing, payment and delivery details) is correct and complete. You are responsible for keeping your account login secure, and you may not transfer your account to anyone else.
SECTION 2 – OUR PRODUCTS
We work hard to describe and display our products accurately. Colours and appearance may vary slightly depending on your screen. We may update product descriptions, discontinue products and limit quantities per customer. If a product does not match what was agreed, you have the rights described in Section 6.
Information on our website is general and does not replace advice from a doctor. Always read the instructions for use before using a product.
SECTION 3 – ORDERS
When you place an order, you make an offer to buy. The agreement becomes binding when we confirm your order by email. We may decline an order, for example if a product is out of stock or a price is clearly wrong. If that happens, we will notify you and refund any payment in full.
Products are sold for personal use, not for resale.
SECTION 4 – PRICES AND PAYMENT
All prices are in Norwegian kroner (NOK) and include VAT. Shipping costs are shown at checkout before you pay. The price that applies is the price at the time of your order, as shown in your order confirmation. Campaigns may have their own terms, which then apply alongside these Terms.
Available payment methods are shown at checkout. You confirm that you are entitled to use the payment method you choose.
SECTION 5 – SUBSCRIPTIONS
Some products can be bought as a subscription with regular deliveries. Price, delivery frequency and how to cancel are shown before you order and are described in our Subscription Terms. There is no binding period, and you can cancel at any time.
SECTION 6 – DELIVERY, RIGHT OF WITHDRAWAL AND COMPLAINTS
Delivery times are estimates; see our Shipping Policy. The risk for the goods passes to you when you, or someone you have designated, receives them.
You have a 14-day right of withdrawal from the day you receive your order. Your first order is also covered by our 30-day money-back guarantee. See our Refund Policy for details.
If a product is faulty, you may make a complaint under the Consumer Purchases Act. You must do so within a reasonable time after you discovered the fault, and no later than two years after delivery. Contact us at hello@sinavita.com.
SECTION 7 – INTELLECTUAL PROPERTY
All content in the Services, including text, images, video, graphics, design and trademarks, is owned by MIM Pharma AS or our licensors and is protected by Norwegian and international law. You may use the Services for personal, non-commercial purposes only. You may not copy, publish or distribute our content without our written consent.
The SinaVita name and logo are trademarks of MIM Pharma AS. Shopify’s name and logo are trademarks of Shopify. Other names and logos belong to their respective owners.
SECTION 8 – THIRD-PARTY TOOLS AND LINKS
The Services may include tools and links provided by third parties, such as payment, reviews or delivery tracking. We do not control these services, and their own terms apply. Use of third-party websites is at your own risk.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
SinaVita is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with MIM Pharma AS. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and MIM Pharma AS, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with MIM Pharma AS.
SECTION 10 – PRIVACY
Personal data we collect is processed according to our Privacy Policy. Because the store runs on Shopify, Shopify also processes some personal data according to its own privacy policy.
SECTION 11 – REVIEWS AND FEEDBACK
If you send us reviews, ideas or other feedback, you give us a free, non-exclusive right to use and publish it in our channels, with your first name if you wish. You confirm that the content is your own honest experience, that you have disclosed any compensation you received, and that it contains nothing unlawful or offensive. We may edit or remove content that breaks the law, these Terms or the rules for marketing our products.
SECTION 12 – ERRORS
If there is a typing error or a clearly wrong price in the Services, we may correct it and cancel affected orders, even after you have placed them. If you have already paid, we will refund you in full.
SECTION 13 – PROHIBITED USE
You may use the Services only for lawful purposes. You may not upload malicious code, attempt to bypass our security measures, collect other people’s personal data, send spam, or use bots, scraping or other automated tools to access the Services without our permission.
SECTION 14 – AUTOMATED AGENTS
Software that acts on someone’s behalf (for example an AI agent) may access the Services only if it identifies itself in every request by including “Agent/[agent name]” in its user-agent string. It must not imitate human behaviour or bypass CAPTCHAs, and it must answer truthfully if asked whether it is automated. We may limit or block such access.
SECTION 15 – TERMINATION
We may block your access to the Services if you break these Terms. Orders we have already confirmed will be handled according to these Terms.
SECTION 16 – LIABILITY
To the extent permitted by law, we are not liable for indirect losses resulting from your use of the Services. This does not apply to losses caused by gross negligence or intent. It also does not limit your mandatory consumer rights or our liability for personal injury under Norwegian law.
SECTION 17 – CHANGES TO THESE TERMS
We may update these Terms. The version in force when you place an order applies to that order. We will notify active subscribers of material changes by email before they take effect.
SECTION 18 – GOVERNING LAW AND DISPUTES
These Terms are governed by Norwegian law. If you have a complaint, please contact us first, and we will do our best to find a solution. You can also contact the Norwegian Consumer Council (Forbrukerrådet, forbrukerradet.no) for help with mediation, and the case may be brought before the Consumer Complaints Committee (Forbrukerklageutvalget). As a consumer, you may bring a case before the courts where you live.
SECTION 19 – OTHER PROVISIONS
If any provision of these Terms is found invalid, the remaining provisions still apply. If we do not enforce a right, that does not mean we waive it. We may transfer this agreement to another company in our group or to a buyer of the business, without reducing your rights as a consumer.
